Refrigeration Products Warranty


Terms and Conditions
Kold Pack, Inc. (hereinafter referred to as "The Seller") Refrigeration Products Warranty - Except where different express written warranty has been issued with respect to a particular product, no warranty of any kind, express or implied, is extended by the seller to any person or persons other than its direct buyers. Products manufactured by seller are guaranteed to be free from defects in materials and workmanship for a period not to exceed (1) one year from date of original invoice. The seller warrants only that it will furnish a replacement for, or at its option repair, the product of its manufacture or part or portion thereof, proved to its satisfaction to be defective in material or workmanship under normal use and service when returned to us freight prepaid. The seller shall have no responsibility for the performance of any product sold by it under conditions varying materially from those under which such product is usually tested under existing industry standard s, nor for any damage to the product from abuse or misuse, nor for the design or operation of any system of which any product may be made a part or for suitability of any such product for any particular application. The seller shall not be liable for any cost or expense incurred including without limitation, freight, labor expense, or loss of refrigerant and materials in connection with the removal or replacement of alleged defective equipment or any part or portion thereof, nor for incidental or consequential damages of any kind including but not limited to loss of refrigerated products, nor under any circumstances for any damage beyond the original purchase price of the goods sold.

The foregoing is in lieu of all other warranties, express or implied, notwithstanding the provisions of the uniform commercial code, the Magnuson-Moss Warranty - Federal Trade Commission Improvement Act, or any other statutory or common law, federal or state. Seller makes no warranty, express or implied, of fitness for any particular purpose, or of any other nature whatsoever, with respect to products manufactured or sold by seller hereunder, except as specifically set forth above and on the face hereof, it is expressly understood and agreed that seller shall not be liable to buyer, or any customer of buyer, for direct or indirect, special, incidental, consequential, or penal damages, or for any expenses incurred by reason of the use or misuse by the buyer or third parties of said products. To the extent said products may be considered "Consumer Products," as defined in Sec. 101 of the Magnuson - Moss Warranty - Federal Trade Commission Improvement Act, seller makes no warranty of any kind, express or implied to "Consumers," except as specifically set forth above and on the face hereof.



OPTIONAL
Five-Year Compressor Part Only Product Protection Plan


Terms and Conditions
The total period of this Plan is from date of original invoice by KOLD PACK to the buyer and will continue for a total of five (5) years and includes the manufacturer’s warranty of one (1) year on parts.

The compressor part is covered by the manufacturer (Tecumseh or Copeland) for the first year following the date of invoice. In the event of failure, a replacement compressor should be obtained “over the counter” from the closest Tecumseh or Copeland wholesaler. During the first year the compressor should be “no charge, warranty exchange”. In the event of a problem, contact KOLD PACK, INC. Jackson, Michigan, 1-800-824-2661 for assistance.

Kold Pack Plan coverage for the compressor part only will begin upon the first day of the second year and will continue for a total of five (5) years from date of the original invoice. Claims in years two through five must be sent directly to Kold Pack. In the event of a failure in years two through five, the compressor should be obtained from the closest Tecumseh or Copeland wholesaler. In order to obtain warranty credit from Kold Pack, a copy of the wholesaler’s invoice and the serial number tag from the dome of the original compressor must accompany the claim. This plan covers the original compressor only, subsequent compressors are not covered.

The Plan will pay to repair and/or replace the compressor part only which fails under normal use, up to the aggregate limit(s) of coverage indicated on Plan certificate issued at time of purchase. Labor coverage is not included in this plan. Extra charges for taxes, refrigerant, external parts or electrical components, mileage or shipping are not covered. Nuisance calls are not covered by this Plan.

Only repairs that are attributed to normal failure of the electrical and mechanical functions of the unit are covered. Failure due, but not limited to, abuse, negligence, impact, fire, lightning, power failures and/or surges, rust, corrosion and water supply failures are not covered. Damage and/or repairs to cabinets and all exterior components, normal maintenance, related duct work, power surges, electrical spikes or electrical circuit overloads, cleaning of drains, filters, batteries, knobs, ect. are not covered. Additional or unusual utility bills incurred due to any malfunction or defect in equipment and labor cost of gaining access to or removal of a unit that requires special equipment or tools such as cranes, ladder trucks, ect. are not covered. Maintenance needed to keep the product in “good operating condition” is not covered. This includes, but is not limited to, cleaning, tune-ups, fuses, nozzles, pilot orifices, adjustment of customer controls and customer product education, Labor, material expenses or equipment required to comply with laws and/or regulations imposed or set forth by any governmental agencies including , but not limited to, the storage, handling , recovery and/or recycling of refrigerants are not covered by this Plan.

Any representation of this Plan other than the terms herein are not binding on the manufacturer, Kold Pack, Inc. or their agents nor shall they be liable for any incidental or consequential damages. This Plan gives you specific legal rights, and you may have other rights that vary from state to state.

Kold Pack, Inc. Order Number is also the system serial number. Please include this number in any claim reports.



OPTIONAL
Comfort Guard One-Year Parts and Labor Product Protection Plan for
Kold Pack, INC. REFRIGERATION PRODUCTS


Terms and Conditions
The total period of this Plan is from one day after the successful installation and operation of the equipment in accordance with the manufacturer’s specifications and will continue for a total of one (1) year and includes the manufacturer’s warranty of one (1) year on parts.

Component parts are covered by the manufacturer (KOLD PACK, INC. Jackson, Michigan 49201) and the original, defective component must be returned to KOLD PACK, INC. for replacement under their warranty. Claims for parts during the period of this warranty must be sent directly to KOLD PACK, INC.

Comfort Guard Plan coverage for labor only will begin the day after the successful installation and operation of the equipment in accordance with the manufacturer’s specifications and will continue for a total of one (1) year. Work on this product must be by an authorized Comfort Guard contractor. Claims for labor during the period of this warranty must be sent directly to the Administrator.

The Plan will pay for labor to repair and/or replace parts that fail under normal use at rates established by separate Service Center Agreements. Extra charges such as mileage or shipping are not covered. Nuisance calls are not covered by this Plan. All labor is reimbursed at the approved rate, regardless of the day of the week or time of day that the service is performed.

WALK-IN Products Warranty


Terms and Conditions
Kold Pack, Inc. (hereinafter referred to as "The Seller") Walk-In Cooler/Freezer Products Warranty - Except where different express written warranty has been issued with respect to a particular product, no warranty of any kind, express or implied, is extended by the seller to any person or persons other than its direct buyers. Panels manufactured by seller are guaranteed to be free from defects in materials and workmanship for a period not to exceed (5) five years from date of original invoice. Original equipment components (refrigeration, door hardware, ect. - other than panels) are guaranteed to be free from defects in material and workmanship for a period of (1) one year. The seller warrants only that it will furnish a replacement for, or at its option repair, the product of its manufacture or part or portion thereof, proved to its satisfaction to be defective in material or workmanship under normal use and service when returned to us freight prepaid. The seller shall have no responsibility for the performance of any product sold by it under conditions varying materially from those under which such product is usually tested under existing industry standards, nor for any damage to the product from abuse or misuse, nor for the design or operation of any system of which any product may be made a part or for suitability of any such product for any particular application. The seller shall not be liable for any cost or expense incurred including without limitation, freight, labor expense, or loss of refrigerant and materials in connection with the removal or replacement of alleged defective equipment or any part or portion thereof, nor for incidental or consequential damages of any kind including but not limited to loss of refrigerated products, nor under any circumstances for any damage beyond the original purchase price of the goods sold.
